Welcome to New Wave Boyz. These Terms of Service ("Terms") govern your use of newwaveboyz.com (the "Site") and any purchases, event tickets, promotions, and communications offered by New Wave Boyz ("New Wave Boyz," "we," "us," or "our"). By using the Site, placing an order, or signing up for our list, you agree to these Terms. If you do not agree, please do not use the Site.
You must be at least 18 years old, or the age of majority where you live, to make purchases on the Site. If you are younger, you may use the Site only with the involvement and permission of a parent or legal guardian.
You agree to give us accurate, current, and complete information when you place an order, sign up, or create an account, and to keep it up to date. If you create an account, you are responsible for keeping your login details confidential and for all activity under your account.
We try to show our products, colors, and sizing as accurately as possible, but colors may look different on different screens and slight variations can occur. Many of our releases are limited drops and are available only while supplies last. We do not guarantee that any product will be available or restocked, and we may discontinue items at any time.
All prices are listed in U.S. dollars and may change at any time without notice. Applicable taxes and shipping charges are added at checkout. Payment is due when you place your order and is processed by our third-party payment processors. If a product is listed at an incorrect price because of a typo or system error, we may cancel any orders placed at that price, even after the order has been confirmed, and will refund any payment received.
Your order is an offer to buy, and it is accepted only when we ship it. We may refuse, limit, or cancel any order for any reason, including suspected fraud, unauthorized resale, inventory errors, or pricing errors. To keep drops fair, we may limit quantities per person, household, payment method, or address, and we may cancel orders placed using bots, scripts, or other automated tools. If we cancel an order after you have been charged, we will refund you.
We ship to the addresses you provide at checkout. Shipping times are estimates and are not guaranteed. Risk of loss passes to you when your order is handed to the carrier. Please double-check your address; we are not responsible for packages delivered to an incorrect address you provided. If your package is lost or damaged in transit, contact us and we will work with the carrier to help resolve it.
Unless a separate return policy is posted on the Site or shown at checkout, eligible items may be returned or exchanged within 14 days of delivery if they are unworn, unwashed, and in original condition with tags attached. Items marked final sale, limited or exclusive drop items, and items bought with certain promotions may not be eligible for return. Return shipping costs are the customer's responsibility unless the item arrived damaged, defective, or incorrect. To start a return or exchange, email us with your order number. Approved refunds are issued to the original payment method.
Tickets for New Wave Boyz events are non-refundable and non-transferable unless the event is canceled or we state otherwise. If an event is canceled, we will offer a refund or credit. We may change event dates, times, locations, or lineups when necessary. We may refuse entry to or remove anyone who behaves in an unsafe, unlawful, or disruptive way. By attending an event, you agree that we may photograph or record the event and use footage that may include you for promotional purposes.
Discount codes and promotions are subject to the terms stated in the offer. Unless otherwise stated, they cannot be combined, have no cash value, cannot be applied to past purchases, and may expire or be withdrawn at any time. Giveaways and contests may have additional official rules, which will apply in addition to these Terms.
By checking the consent box and submitting your email, you agree to receive marketing and promotional emails from New Wave Boyz. You can unsubscribe at any time using the link in any email. If you separately opt in to text messages, you agree to receive recurring marketing texts; consent is not a condition of purchase, message and data rates may apply, and you can reply STOP to opt out or HELP for help. The New Wave Boyz name, logos, designs, graphics, photos, videos, text, and all other content on the Site belong to New Wave Boyz or its licensors and are protected by trademark, copyright, and other laws. You may not copy, reproduce, sell, modify, or use our content or designs, including to make counterfeit or look-alike products, without our written permission.
If you tag New Wave Boyz, use our hashtags, or send us photos, reviews, or other content, you give us a non-exclusive, royalty-free, worldwide license to use, display, and share that content in connection with our brand and marketing, with credit to you where practical. You confirm that you own the content or have permission to share it.
You agree not to: use the Site for anything illegal; use bots, scripts, or automated tools to buy products, enter giveaways, or scrape the Site; interfere with the Site's security or operation; submit false information or use someone else's payment method without permission; resell products in violation of purchase limits; or harass, threaten, or harm others.
The Site may use or link to third-party services, such as payment processors, shipping carriers, ticketing platforms, and social media. We are not responsible for their content, policies, or practices, and your use of them is at your own risk and subject to their terms.
The Site and all products and services are provided "as is" and "as available." To the fullest extent permitted by law, New Wave Boyz disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by law, New Wave Boyz and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Site, our products, or our events. Our total liability for any claim will not exceed the amount you paid us for the product or service giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to defend, indemnify, and hold harmless New Wave Boyz and its owners, employees, and partners from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of another person.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us first and try to resolve the issue informally. Any legal action relating to these Terms or the Site must be brought in the state or federal courts located in Hillsborough County, Florida, and you consent to the jurisdiction of those courts.
We may update these Terms at any time by posting the revised version on this page and changing the effective date. Changes apply from the time they are posted. Your continued use of the Site after that means you accept the updated Terms.
If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms, together with our Privacy Policy and any policies posted on the Site, are the entire agreement between you and New Wave Boyz about the Site.
